Where the purposes and means of such processing are determined by Union law or the law of the Member States, the controller or the specific criteria for its designation may be provided for by Union law or the law of the Member States. <\/li>\n<li>g) Processor means a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller.<\/li>\n<li>h) Recipient means a natural or legal person, public authority, agency, or other body to which personal data are disclosed, regardless of whether it is a third party or not. However, public authorities that may receive personal data in the context of a particular inquiry in accordance with Union law or the law of the Member States shall not be regarded as recipients. <\/li>\n<li>i) Third Party means a natural or legal person, public authority, agency, or body other than the data subject, the controller, the processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data.<\/li>\n<li>j) Consent means any freely given, specific, informed, and unambiguous indication of the data subject\u2019s wishes by which the data subject, through a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.<\/li>\n<\/ol>\n<h2>\u00a7 3 Provision of the Website and Creation of Log Files<\/h2>\n<p>(1) When using the website for informational purposes only\u2014that is, if you do not register or otherwise transmit information to us\u2014we automatically collect the following data and information from the computer system of the accessing device each time the website is accessed:<\/p>\n<ul>\n<li>The IP address of the user<\/li>\n<li>Information about the browser type and version used.<\/li>\n<li>The operating system of the user<\/li>\n<li>The user\u2019s Internet service provider<\/li>\n<li>Date and time of access<\/li>\n<li>Websites from which the user\u2019s system accesses our website.<\/li>\n<li>Websites that are accessed by the user\u2019s system via our website.<\/li>\n<li>Content of the requests (specific pages accessed)<\/li>\n<li>The volume of data transmitted in each case<\/li>\n<li>Language and version of the browser software<\/li>\n<\/ul>\n<p>The data are also stored in our system\u2019s log files. These data are not stored together with any other personal data of the user. <\/p>\n<p>(2) The legal basis for the temporary storage of log files is Article 6(1)(f) GDPR, which permits processing that is necessary for the purposes of the legitimate interests pursued by the controller.  <\/p>\n<p>(3) The temporary storage of the IP address by the system is necessary in order<\/p>\n<ul>\n<li>to enable the delivery of the website to the user\u2019s device. For this purpose, the user\u2019s IP address must remain stored for the duration of the session. <\/li>\n<li>to optimize the content of our website and the advertising for it.<\/li>\n<li>to ensure the functionality of our information technology systems and the technical operation of our website<\/li>\n<li>to provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyberattack<\/li>\n<\/ul>\n<p>The storage of data in log files is carried out to ensure the functionality of the website. In addition, the data help us optimize the website and maintain the security of our information technology systems. In this context, the data are not analyzed for marketing purposes  <\/p>\n<p>These purposes also constitute our legitimate interest in processing the data pursuant to Article 6(1)(f) of the GDPR  <\/p>\n<p>(4) The data are deleted as soon as they are no longer required for the purpose for which they were collected\u2014in this case, at the end of the respective usage session. Where the data are stored in log files, they are deleted no later than seven days after collection.<br \/>Storage beyond this period is possible. In particular, you may request the deletion of your personal data where:<\/p>\n<ul>\n<li>the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;<\/li>\n<li>You withdraw your consent on which the processing was based pursuant to Article 6(1)(a) or Article 9(2)(a) GDPR, and there is no other legal basis for the processing.     <\/li>\n<li>You object to the processing pursuant to Article 21(1) GDPR, and there are no overriding legitimate grounds for the processing; or you object to the processing pursuant to Article 21(2) GDPR.    <\/li>\n<li>the personal data have been processed unlawfully;<\/li>\n<li>The erasure of personal data concerning you is required for compliance with a legal obligation under Union law or the law of a Member State to which the Controller is subject.<\/li>\n<li>The personal data concerning you were collected in relation to the offer of information society services pursuant to Article 8(1) GDPR. <\/li>\n<\/ul>\n<p>Where the Controller has made the personal data concerning you public and is obliged pursuant to Article 17(1) GDPR to erase such data, the Controller shall, taking account of available technology and the cost of implementation, take reasonable measures, including technical measures, to inform other controllers processing the personal data that you, as the data subject, have requested the erasure of any links to, copies of, or replications of those personal data.  <\/p>\n<p>The right to erasure does not apply where processing is necessary:<\/p>\n<ul>\n<li>for exercising the right to freedom of expression and information;<\/li>\n<li>for compliance with a legal obligation that requires processing under Union law or the law of a Member State to which the Controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;<\/li>\n<li>for reasons of public interest in the area of public health in accordance with Article 9(2)(h) and (i), and Article 9(3) GDPR;   <\/li>\n<li>for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes pursuant to Article 89(1) GDPR, insofar as the right to erasure is likely to render impossible or seriously impair the achievement of the objectives of that processing; or  <\/li>\n<li>for the establishment, exercise, or defense of legal claims.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong> Right to Notification<\/strong><\/li>\n<\/ol>\n<p>If you have exercised your right to rectification, erasure, or restriction of processing vis-\u00e0-vis the Controller, the Controller is required to communicate such rectification, erasure, or restriction of processing to all recipients to whom the personal data concerning you have been disclosed, unless this proves impossible or involves a disproportionate effort.<br \/>You have the right to be informed by the Controller about those recipients. <\/p>\n<ol start=\"6\">\n<li><strong> Right to Data Portability<\/strong><\/li>\n<\/ol>\n<p>You have the right to receive the personal data concerning you that you have provided to the Controller in a structured, commonly used, and machine-readable format. This right must not adversely affect the rights and freedoms of others. <\/p>\n<p>The right to data portability does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller.<\/p>\n<p>To exercise the right to data portability, the data subject may contact the Controller at any time.<\/p>\n<ol start=\"7\">\n<li><strong> Right to Object<\/strong><\/li>\n<\/ol>\n<p>You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you that is based on Article 6(1)(e) or Article 6(1)(f) GDPR, including profiling based on those provisions.  <\/p>\n<p>The Controller shall no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or unless the processing serves the establishment, exercise, or defense of legal claims.<\/p>\n<p>Where personal data concerning you are processed for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for such marketing purposes.
